Terms of service

These Terms of Service ("Terms") cover what you can and can't do with the PhoenixVPN service. They form a binding agreement between you and BIBERSON TECHNOLOGIES LLC, a limited liability company organized under the laws of the State of Colorado, United States, with its principal place of business at 55 S Forest St, Denver, CO 80246, United States ("PhoenixVPN", "we", "us"). By creating an account or using the service, you agree to these Terms.

  • Don't use PhoenixVPN to break the law.
  • Don't try to break PhoenixVPN.
  • You're responsible for what you do with your connection.
  • If we suspend your account, we'll tell you why.

1. Your account

Keep your password secure. You're responsible for activity that happens under your account. If you suspect your account has been compromised, email [email protected] immediately. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create an account.

2. Acceptable use

You may not use PhoenixVPN to:

  • Send spam (commercial or otherwise).
  • Distribute malware or otherwise compromise the security of other systems.
  • Engage in unauthorized scanning, probing, or denial-of-service attacks.
  • Distribute or access content that is illegal in your jurisdiction (notably: child sexual abuse material).
  • Resell the service without a Teams / reseller agreement in place.

3. Subscriptions and billing

Subscriptions renew automatically at the end of each billing period. You can cancel at any time from your dashboard — your access continues until the end of the period you paid for.

Prices may change. If your subscription is set to auto-renew and we change the price, we'll email you at least 30 days before the change takes effect.

5. Service availability

We aim for 99.9% monthly uptime. If a server goes down, smart routing reconnects you to a working one — there's no SLA for any individual server.

6. Termination

We may suspend or terminate your account if you breach these terms (especially the acceptable use clause). If we do, we will tell you why and, when possible, give you a chance to remedy the issue first.

7. Disclaimer of warranties

The service is provided "as is". We do our best to keep it fast, secure, and available — but software is software, networks are networks, and we don't warrant that the service will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of these terms is capped at the amount you've paid us in the twelve months before the claim arose.

9. Changes to these terms

When we change these terms in any material way, we'll email every active customer at least 30 days before the change takes effect.

10. Governing law and venue

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the service that is not resolved through informal negotiation will be brought exclusively in the state or federal courts located in Denver, Colorado, and you consent to the personal jurisdiction of those courts.

11. Entire agreement

These Terms, together with our Privacy Policy, Refund Policy, and No-Logs Policy, constitute the entire agreement between you and BIBERSON TECHNOLOGIES LLC regarding the PhoenixVPN service and supersede any prior agreements.
